O papel de atividade de argumentadora em uma audiência no Juizado Especial Criminal
Abstract
The aim of this study is to investigate the activity role of the arguing performed by the conciliator in a Criminal Special Court (JECrim), a legal instance destined to process infractions and minor criminal offenses. To do so, we draw on studies on activity roles (Sarangi, 2010; Halvorsen; Sarangi, 2015) and the interactional argumentation approach (Schiffrin, 1984). Our methodology is qualitative-interpretative (Denzin; Lincoln, 2006), and actual data of talk-in-interaction were transcribed according to the Jefferson transcription model (Loder, 2008). The results of the analysis show that the emergence of the arguing role is directly related to the process of persuading the parties to dismiss the case. In performing this role, the professional carries out actions of presenting, reformulating, and sustaining their position, and refuting the positions of the misaligned parties.
